Garments |
| a) |
All
Garments provided by us shall be in good condition
and free from defects and staining, having passed
through our various inspection and processing
facilities. However, due to dry cleaning there may
be slight shading differences in garments, e.g. for
large wedding parties. |
| b) |
We
do not accept responsibility for the fit of garments
if orders have been completed incorrectly. All
telephone orders will be read back to you as we
enter them onto our system. It is your
responsibility to check these details are correct,
as we do not accept liability for telephone orders
after we read them back to you. |
| c) |
We
reserve the right to substitute the size of any of
the Garments in the Order to the nearest half size
as set out below: |

| d) |
We
offer a free “Try-on” service for grooms only. A
“Try-on” order must be arranged directly with us
over the telephone and must confirmed back
to you as a “Try-on”. A charge of £10 will be
taken for each “Try-on” order (limited to one
per wedding), this charge is non-refundable but will
be deducted from your eventual final order price.
All “Try-on” orders must be ready for collection
on the first working day after the delivery date. |

| 2. |
Deliveries |
| a) |
No
order shall be accepted unless a function date is
stated on the Order Form or confirmed to us over the
telephone. |
| b) |
Deliveries
can be made up to 5 working days before a function
date, providing we have the order at least 8 working
days prior to a function date. |
| c) |
Hire
costs (as shown on the ‘Price List’) include
delivery & collection by third party carrier on
a 48 hour service (orders placed after 3pm on the
order date will be delivered 3 working days later).
Deliveries will be made between 9am and 5pm on the
delivery date. |
| d) |
“Last
Minute” orders mean orders placed within 1 working
days of a function date. These will, without
exception, be dispatched on an upgraded delivery
service, to arrive the next day. This will incur a
extra charge of £7 if ordered before 3pm or £17 if
ordered after 3pm. |
| e) |
We
do not accept responsibility for any failure to
deliver by any third party carriers. |
| f) |
Hire
orders may be extended for additional weeks at a
rate of 50% of the normal hire charge for each
additional week or part week. |
| g) |
We
will not be liable to you if the Delivery Date is
after the date of delivery required by you in the
Order if such delay was beyond our reasonable
control. In the event of such delay we shall
exercise every effort to deliver the goods as soon
as reasonably possible. |

| 3. |
Changes
to original order |
| a) |
We
will charge 50p per garment for any change made
against the original order within one month (but
more than one week) of your dispatch date. |
| b) |
We
will charge £1 per garment for any change made
against the original order within one week of your
dispatch date. |
| c) |
We
will not charge for the supply of 1 replacement
garment should the original order not fit
satisfactorily (NB THIS DOES NOT INCLUDE TOP HATS)
so long as we are informed within 24 hours of the
delivery date. Replacement garments will be
despatched on a third party carrier on a standard
48-hour delivery service (2 working days).
Replacement garments requested within 3 working days
of the function date will, without exception, be
despatched on an upgraded delivery service, to
arrive
the following day at supplementary cost of £7. |

| 4. |
Cancellation
of order |
|
In
the event of the order being cancelled within 48
hours of the dispatch date you will be expected to
pay the full cost for each suit ordered. For
cancellations notified to us prior to 48 hours
before a dispatch date you be entitled to a full
refund. |

| 5. |
Care
of Garments & Accessories |
| a) |
You
agree to treat the garments and accessories with
reasonable care.
|
| b) |
You
will be responsible for the safe keeping and safe
return of the garments from such point as the
garments are delivered to you and until they are
returned to us.
|
| c) |
You
will not modify or alter in any way those garments
which have been delivered to you in accordance with
the order and you will become liable for all
payments and charges made by us in rectifying and/or
replacing such garments which are modified.
|
| d) |
You
agree to notify us immediately in writing of any
loss or damage to the garments once you become aware
of such loss or damage and be liable to us for the
full replacement / repair costs. We will notify you
of other losses / damage not notified to us and
charge you the full replacement / repair costs.
|
| e) |
Please
take particular care of top hats. Under no
circumstances should they be thrown in the air.
|
| f) |
Please
be advised that the Skean Dhu and kilt pin, both
supplied with Adult Highland Wear Outfits, has (in
the case of the Skean Dhu) a real blade and must not
be removed from its sheath and (in the case of the
kilt pin) a sharp point and must not be removed from
the kilt.
|
| g) |
As
the Skean Dhu and kilt pin are decorative
accessories only, we do not accept any
responsibility for any damages, costs, claims,
losses, expenses or liability whatsoever incurred by
us, and howsoever arising as a result of misuse of
the Skean Dhu and/or kilt pin and you will indemnify
us for any such damages, costs, claims, losses,
expenses or liabilities. You agree for the purposes
of the Unfair Contract Terms Act 1977 that this
liability exclusion is reasonable in the
circumstances. In the event that this condition is
deemed unenforceable, that shall not affect the
validity or enforceability of any other provision of
this contract, it being the intention of you and us
that all conditions of this agreement shall be valid
and enforceable. |
| h) |
You
agree as an obligation surviving termination of this
agreement to indemnify us in respect of any claims
made against us and all damages costs and expenses
suffered or incurred by us as a result of any third
party claim arising out of the garments or in any
way arising out of the garments being let under this
agreement

|
| 6. |
Return
of Garments
|
| a) |
All
garments and accessories must be ready for
collection on the first working day after the
function date. Collection will be made from the
collection address (supplied by you at the time of
booking) between 9am and 5pm on the collection date
by third party carrier. You will be wholly
responsible for ensuring that the garments are ready
for collection and are correctly labelled and safely
passed to the carrier, whereupon the garments will
no longer be deemed to be in your possession (we
recommend you retain the consignment note given to
you by the carrier and signed by you for up to one
month as good evidence that the collection was
successful).

| b) |
In
the event of a “failed collection” you will be
wholly responsible for contacting us to make
alternative arrangements, and will be liable for any
collection costs incurred (£5) and any additional
charges for late return (£5 per suit per day after
the stated return date).

| 7. |
Accidental
Damage Waiver |
| a) |
Should you choose to pay a premium of £5
per suit for Accidental Damage Waiver we will waive
any charges that would normally arise following
accidental damage to any of the garments, provided
that they are being used appropriately (with the
exception of Top
Hats, which are NOT
covered by this waiver) |
| b) |
The
waiver does not cover garments which have in our
opinion been damaged through inappropriate use. |
| c) |
Please
remember that any personal insurance you may already
hold does not cover the garments and accessories
hired to you by us.
|
| d) |
We
reserve the right to charge for any garment and/or
accessory which is lost or stolen as these are not
covered by the Accidental damage Waiver; a full list
of charges can be found in our ‘Price List’
under ‘ New Prices’.
|
| e) |
S
uit covers, hat boxes and bags are loaned at no
extra cost but are subject to a surcharge of £15
each if not returned or if returned damaged. |

|
| 8. |
Deposit |
|
No
security deposit is required however your
authorization is mandatory (required at the time of
booking) that in the event of non-returned or
damaged garments (unless Accidental Damage Waiver
cover is taken) that we are authorized to deduct the
full replacement value of the garments directly from
your credit or debit card.

|
| 9. |
Refund
Polic
y |
| a) |
In
the unlikely event of us supplying faulty garments
we will be happy to rectify the problem or refund
the price paid as long as you contact Hire Society
within 24hrs of receiving the garments. |
| b) |
If
you need to change the sizes of the garments then
Hire Society will be pleased to offer 1 free
replacement per order. This will be delivered with
in 48hrs (should it need to be within 24hrs then a
supplement will apply). NB This does not apply to
top hats – any change-over for a top hat will be
at the expense of the customer.

| c) |
Orders
taken over the phone will be confirmed back to the
customer. Hire Society will not be held responsible
for orders that are misplaced over the phone and
confirmed via email.
|
| d) |
In
the event of the order being cancelled within 48
hours of the dispatch date you will be expected to
pay the full cost for each suit ordered. For
cancellations notified to us prior to 48hours before
a DISPATCH date you be entitled to a full refund.

Miscellaneous |
|
This
contract is governed by English Law and the English
Courts shall have jurisdiction. |
